关于：仿冒LED芯片

尊敬的客户：

近来，我们发现某些公司正在生产、销售采用与普瑞光电股份有限公司（以下称“普瑞光电”）的产品相同布图设计的LED芯片（以下称“仿制芯片”），并宣称该等侵权产品可取代普瑞光电的产品。同时，我们还发现某些公司正在生产和销售假冒的普瑞光电芯片产品（以下称“假冒芯片”）。该等仿制芯片和假冒芯片侵犯了普瑞光电的知识产权，并可能侵犯普瑞光电的专利权。需要着重指出的是，该等仿制芯片和假冒芯片无法受到普瑞光电自美国科锐公司、日本东芝公司、台湾晶元光电股份有限公司处取得的专利许可的保护。在您的产品中使用该等仿制芯片和假冒芯片，将给贵司、甚至贵司的下游客户带来知识产权侵权的法律风险，并可能导致停止侵权、赔偿损失等法律责任。

普瑞光电自2006年以来一直在中国销售LED芯片产品，并以产品的创新性、高品质、高性能、高价值以及强有力的知识产权保护所带来的良好声誉为傲。我们的客户提醒我们留意这些仿制芯片。例如某些公司在其规格书中记载的布图设计与普瑞光电的BXCD45和BXFD45芯片相同。而就该等布图设计，普瑞光电已经进行申请登记。

这个问题引起了我们的高度重视，尤其是因为该等仿制芯片和假冒芯片将损害到追求正品普瑞光电LED芯片的高性能和有力的知识产权保护的客户和光源生产商。普瑞光电在其专有技术上进行了大量投资，并以其优良的品质、优秀的性能、非凡的价值和有力的知识产权保护在中国赢得了良好的声誉。

我们已委托中国的律师事务所向仿制芯片或假冒芯片的生产者和销售者发函，要求其停止一切侵权行为。为避免您和其他客户、集成商因其产品受到损失，我们特此致函告知上述情况，以期您受益于真正的普瑞光电品牌的LED产品，给您留下深刻印象。

We recently discovered that some company is manufacturing and selling LED chips with a mask work design identicalto the Bridgelux LED chip product (“Copycat Chips”) and is marketing and promoting the infringing products as interchangeable with the Bridgelux products. We also found that some companies are manufacturing and selling counterfeit Bridgelux chip products (“Counterfeit Chips”). Such Copycat Chips and Counterfeit Chips infringe Bridgelux’s intellectual property rights. We are also concerned that the fake LED chip products may infringe Bridgelux patents. It is also important to note that such Copycat Chips and Counterfeits Chips are not protected under the Bridgelux patent licenses with Cree, Inc., Toshiba Corporation and Epistar Corporation.To use such Copycat Chips and Counterfeit Chips in your products could expose your esteemed company and even your downstream customers to the legal risk of intellectual property right infringement and cause liabilities including in junctive relief and monetary compensation.

Bridgelux has been selling LED chips in China since 2006 and is very proud of its strong reputation for innovation, quality,performance, value and IP protection. Some of our customers brought the Copycat Chips to our attention. In our investigation we found, for example, that some company puts a design on its data sheet that is identical to the design for the Bridgelux BXCD45 and BXFD45. Bridgelux has applied registrations for its mask work designs.

This issue has caused us great concern, particularly since such Copycat Chips and Counterfeit Chips are putting at risk customers and luminaire manufacturers who are looking for the performance and IP protections of genuine Bridgelux LED chips. Bridgelux has invested heavily in its proprietary technologies and has earneda strong reputation in China for quality, performance, value and intellectual property protection.

Our China law firm has notified the company of our concerns and asked them to stop any infringing activities. Given the risk to customers and integrators of their products, we thought it was important to bring this to your attention, and impress upon you the benefits of purchasing genuine Bridgelux branded LED products.

Kindly please note that genuine Bridgelux LED chips are only manufactured through Bridgelux authorized suppliers. If you become aware of any products that you suspect are incorrectly identified as Bridgelux products, represented as interchangeable with Bridgelux products, or infringe Bridgelux’s intellectual property rights, please contact us. Please be aware that sellers of Copycat Chips and Counterfeit Chips are subject to legal liability.
